Participation in the Game, Prize Awarding, and Date: |
Only individuals who have residence or a place of stay in the following European Union countries, possess a valid personal identification card issued by the authorities of a relevant country, have a personal Mobilfox webshop profile, and are at least 16 years old, may participate in the Game. Participants must be capable of acting on their behalf during the entire duration of the Game and not fall within the category of excluded individuals ("Player"). Participating Countries: Hungary, Czech Republic, Croatia, Poland, Spain, Portugal, Germany, Austria, Romania, Bulgaria, Greece, Latvia, Lithuania, Estonia, Slovenia, Slovakia, Netherlands, Belgium. Individuals under the age of 18 can participate in the Game or receive a prize only with the consent of their legal representative. During the game, participants can join the prize game by downloading the uniquely developed Mobilfox App by MOBILREDFOX, creating an individual profile, and completing the registration process prior to starting the game. Point collection begins on 2024.12.15 at 17:00:01 (GMT+1), and points accumulated before this specified time will not be included in the total. During the game, the Organizer will extract the current leaderboard every Sunday at 23:59 (GMT+1) and create a closed database of it, rewarding the top 10 participants with the highest points. Afterward, the results will be deleted from the application, and the leaderboard will be reset, providing an opportunity for other participants to win as well. During the game period, but for no longer than 180 days, a single user can only win once, regardless of their ranking on the leaderboard. This means that if a participant has already won and subsequently ranks among the winners again at a leaderboard closure, the Organizer will officially consider the 11th participant as the 10th-place winner, and so on. We inform you that by participating in the Game, you automatically accept the terms of this Game Regulation. Participation in the Game does not require the purchase of any products on the MOBILREDFOX website apart from completing the registration process. The Game does not qualify as a gambling activity as defined by Act XXXIV of 1991 on the organization of gambling. This Game is not sponsored, endorsed, organized, or associated with Apple in any way. The data provided during the Game is collected in the MOBILREDFOX database and will be used as outlined in the Game Regulation. Apple neither supports nor cooperates with the Game and does not administer or monitor its participants in any manner. |

Participation Conditions: |
To participate in the Game, individuals must create a unique profile (register) in the Mobilfox App in compliance with the terms of this Game Regulation. Participants must accept all the conditions outlined in this Game Regulation and consent to the handling of their provided data as described in the Regulation. During registration, participants are required to provide their phone number, email address, full name, gender, date of birth, and mobile phone type. After successfully logging in, the participant becomes eligible to play the Game and start collecting points to achieve a higher position on the leaderboard. |

The game can be started by clicking the “Start the Game” button. Each week, the top 10 participants on the leaderboard with the most points can win the following prizes:
The Gift Card applies to the total order value but does not cover shipping costs. Prizes are non-transferable and will be awarded exclusively to the winners by the Organizer. Prizes cannot be exchanged for cash, nor are cash refunds possible. Prizes cannot be offered for resale in commercial markets. MOBILREDFOX will notify the winning participant immediately after the draw as follows ("Notification"): MOBILREDFOX will contact the winner via the email address provided in the application within 24 hours of the results announcement. The Organizer will cover the costs of delivering physical prizes to a pre-agreed address. If the winning participant does not use the Gift Card on the MOBILREDFOX website within one (1) year, the Gift Card will become invalid after this period. MOBILREDFOX excludes any participant from the Game if their prize cannot be delivered due to inaccurate, incomplete, or false personal information provided in the confirmation email, or if the participant otherwise fails to meet the personal criteria specified in this Game Regulation. The Organizer assumes no responsibility for issues arising from incorrect data provided by the participant. The Organizer reserves the right to make changes to the prizes during the Game. The Organizer specifies that its responsibility is strictly limited to providing the prizes, and it is not obligated to ensure any additional conditions related to the use of the prizes. MOBILREDFOX excludes any liability for circumstances arising after the prizes have been delivered, including issues related to the use of the prizes by the winner or any third party. |

Employees of MOBILREDFOX, and any economic organizations or agencies involved in organizing or conducting the Game—including their owners, executive officers, employees, or those in any other employment relationship with them—and all relatives of these persons as defined in Section 8:1 (1) point 2 of the Hungarian Civil Code, are not eligible to participate in the Game. A person may participate in the Game only once; that is, a User can fulfill the Participation Conditions only once, regardless of any additional profiles created. Participation in the Game is voluntary and free of charge. Winners who lose their eligibility for the prize due to unsuccessful contact attempts (e.g., not receiving messages because of individual settings in their email program or social media platform) are not entitled to any further claims against MOBILREDFOX. Therefore, MOBILREDFOX excludes its liability for the failure to deliver the prize if the winner becomes unreachable for any reason after the prize has been awarded. If the winner's provided data does not correspond to reality, is incomplete, or if any other reason disqualifies them from claiming the prize, MOBILREDFOX is not obliged to re-deliver the prize. The Winner is responsible for bearing all other arising costs. MOBILREDFOX excludes liability for malfunctions of the application and the website due to reasons beyond its control, during which time the application and website may not be usable or may be limited in functionality. However, MOBILREDFOX will promptly take all necessary measures to identify and eliminate the cause of the malfunction as soon as possible. MOBILREDFOX excludes all liability in cases of external attacks on the application, website, or the server operating them. Therefore, if you receive erroneous system messages as a result of such attacks, MOBILREDFOX assumes no responsibility. MOBILREDFOX is not responsible for the availability and operation of telecommunication and IT devices or for third-party activities. MOBILREDFOX is not liable for the improper functioning of online interfaces due to reasons beyond its control, particularly the failure or unavailability of the server operating the online interface, lack of internet connection, disruptions in the backbone network, or failure to connect to the internet interface or any part of it. MOBILREDFOX will take all reasonably expected measures to ensure that participation in the prize game is possible on all widely used types of computers, mobile phones, operating systems, and internet browsers. However, it does not guarantee or take responsibility for the efficiency with which you can use different systems during participation in the prize game. Participation in the Game using a profile registered by a third party is prohibited. If a User uses a profile not registered by themselves, they will be automatically excluded from the Game. MOBILREDFOX excludes all liability for disputes arising from the authorization to use profiles created in the application related to the Game. Users are identified in the Game based on their account name in the Mobilredfox application. The Organizer assumes no responsibility for technical problems arising from changes in data beyond its control (especially the deletion or unavailability of the user profile). By participating in the game, Users accept the principles of impartial and moderated communication. MOBILREDFOX does not wish to engage in negative communication regarding the game or MOBILREDFOX itself. Questions and complaints related to the game or its organization should be addressed via email to info@mobilfox.com. The data provided in the Game will be stored in the MOBILREDFOX database and will be used as specified in the Game Regulation. MOBILREDFOX reserves the right to unilaterally modify, suspend, or terminate the conditions set forth in this Game Regulation or the Game itself, even during its duration. MOBILREDFOX is entitled to exclude any participant from the Game, particularly if there is suspicion of abuse or violation of the rules, or if a participant manipulates the course of the Game in any way (e.g., by using an emulator, playing from an invalid device such as a laptop or desktop computer, or acting in bad faith in any manner). Any modifications to this Game Regulation, as well as notifications about the suspension or termination of the Game, will be published by MOBILREDFOX on the website mobilfox.com/pages/falling-game-rules. The Organizer will automatically exclude from the Game participants who provide false data. The Organizer may verify Users to ensure compliance with the Game Regulation, and if for any reason they do not meet the conditions, the Organizer may exclude the affected User from the Game. There is no further legal dispute possible regarding the exclusion. Users who participate in the Game with false data may be excluded from the Game at the Organizer's discretion. Participants or Users exhibiting the unfair behavior specified in this section are obliged to compensate for all damages caused to the Organizer in connection with the Game. MOBILREDFOX reserves the right to immediately exclude a participant from the Game if it detects or has a well-founded suspicion that any User is engaging in any form of manipulation (including computer manipulation), creating mass-generated profiles, or any behavior incompatible with or violating the spirit of the Game. The Organizer assumes no responsibility for the non-delivery or delay of the Prize due to reasons beyond its control, or for any damages arising during delivery. If the winner does not collect their Prize at the time agreed upon in advance with the courier service or the Organizer, they cannot claim it from the Organizer thereafter. Hungarian law governs this Game and the Game Regulation. Taxation MOBILREDFOX undertakes the responsibility for the acceptance of the Prize and the payment of any related taxes. |
DATA PRIVACY NOTICE
By accepting the Terms, you explicitly consent, based on appropriate information, to the processing and storage of your personal data by MOBILREDFOX as the data controller. This processing is in accordance with the European Parliament and Council Regulation (EU) 2016/679, dated April 27, 2016, on the protection of natural persons regarding data processing and on the free movement of such data, repealing Directive 95/46/EC (GDPR), Article 6(1)(a), as well as relevant legal requirements, for the purpose of participation in the Game and communication with MOBILREDFOX for the necessary period until the purpose of data processing is achieved or consent is withdrawn.

Legal Basis of Data Processing
We inform you that MOBILREDFOX processes Players' data based on their consent per GDPR Article 6(1)(a) and processes the data of selected Winners under GDPR Article 6(1)(b) as necessary for the performance of a contract (the delivery of prizes and fulfillment of the gifting contract).
Scope of Data Processed and Retention Period
During the Game organization and prize distribution, MOBILREDFOX will process the following data:
- For all Players: Name, Email Address, Phone Number.
- For Winners: Name, Email Address, Phone Number, and any additional data required for organizing accommodations and travel as requested by the lodging or travel provider.
Data Retention Period:
Data will be stored for 5 years after the end of the Game in accordance with the general limitation period specified in the Hungarian Civil Code. Financial data qualifying as accounting records related to the Prize will be stored for a minimum of 8 years, according to Act C of 2000 on Accounting, Section 169(2).
If we process your data based on your consent, you may withdraw your consent at any time without restriction by emailing info@mobilfox.com. Following withdrawal, MOBILREDFOX will promptly delete your data.
Automated Decision-Making (Including Profiling):
No automated decision-making or profiling is carried out during data processing.
Data Recipients and Categories of Recipients:
In relation to the Game, no targeted data transfer occurs. However, data from registered accounts may be forwarded to data processors (notably Shopify and Infobip), resulting in certain personal data being transferred to third countries (such as the United States). Detailed information on specific data processing, including the legal basis provided by Chapter V of the GDPR, is available in Appendix 3 of the Data Privacy Notice.
Data Security
The data controller takes all reasonable measures to prevent accidental damage or destruction of data. Specific data security measures are detailed in the Data Privacy Notice.
Rights of Data Subjects
The GDPR provides detailed rights and remedies for Players regarding their personal data, as well as any restrictions. Below is a summary of the key provisions.
Right to Information:
If the data controller processes personal data related to the Player, it must inform the Player of the main characteristics of the data processing, including its purpose, legal basis, duration, identity and contact information of the data controller and its representative, the recipients of personal data, and the Player's rights and remedies concerning data processing (including the right to lodge a complaint with the supervisory authority). The data controller provides this information to the Player through this notice.
Right of Access:
Players have the right to receive confirmation from the data controller as to whether personal data concerning them is being processed and, if so, to access such data and relevant information about the processing, including its purposes, the categories of personal data involved, the recipients of the data, the duration of processing (planned), the Player’s rights and remedies (including the right to lodge a complaint), and, where applicable, the source of the data if not collected directly from the Player. Upon request, the data controller provides a copy of the personal data processed to the Player. Additional copies may be provided for a reasonable administrative fee. The right to access must not adversely affect others' rights and freedoms. The data controller provides information on the availability, method, potential costs, and other details of access upon the Player’s request.
Right to Rectification:
Players have the right to request the prompt correction of inaccurate personal data concerning them. Taking into account the purposes of processing, Players may request the completion of incomplete personal data, including through a supplementary declaration.
Right to Erasure ("Right to be Forgotten"):
Players have the right to request that the data controller erase their personal data without undue delay, and the data controller is obligated to delete personal data without undue delay if specific conditions are met. Among others, the data controller must delete personal data if the data is no longer necessary for the purposes for which it was collected or otherwise processed; if the Player withdraws consent and there is no other legal basis for processing; if the data was processed unlawfully; or if the data must be erased to comply with a legal obligation under Union or Member State law. Players should note that the data controller may retain data as required by law even if the Player requests its deletion.
If data processing is based on the Player's consent, the consequence of withdrawing consent is that the Player will not be able to use the application.
Right to Restrict Processing:
Players have the right to request that the data controller restrict processing if any of the following conditions apply:
- The Player contests the accuracy of the personal data, in which case processing is restricted while the accuracy of the data is verified.
- The processing is unlawful, and the Player opposes the erasure of the data, requesting restriction of its use instead.
- The data controller no longer needs the data for processing purposes, but the Player requires it to establish, exercise, or defend legal claims.
If processing is restricted, such personal data may only be processed with the Player’s consent or for legal claims, or for the protection of another natural or legal person’s rights, or for reasons of public interest.
If the restriction on processing is lifted, the data controller will notify the Player in advance.
Right to Data Portability:
Players have the right to receive personal data they have provided to the data controller in a structured, commonly used, and machine-readable format, and they may transmit that data to another data controller without hindrance, where:
- Processing is based on consent or necessary for the performance of a contract (with the Player as a party), and
- Processing is carried out by automated means.
When exercising the right to data portability, the Player may also request direct transfer of the data to another data controller, where technically feasible.
The right to data portability does not adversely affect others' rights and freedoms.
Legal Remedies and Additional Rights
The Right to Complain:
The data controller makes every effort to ensure that personal data is processed in compliance with legal requirements. If the data subject believes that the data controller has not complied, they may send a complaint to info@mobilfox.com or by post to the following address: 1061 Budapest, Dalszínház utca 2, 4th floor, Mobilredfox office.
If the data subject feels that their rights to personal data protection have been violated, they may seek legal remedy with the relevant authorities, including the Hungarian National Authority for Data Protection and Freedom of Information (NAIH) at 1055 Budapest, Falk Miksa utca 9-11., or with a court. Legal remedies and rights are further outlined in the GDPR.
Right to Information Regarding Personal Data Processing:
Data subjects may request information about the processing of their personal data at any time, and the data controller may only refuse to provide information in exceptional cases as outlined by law. If the data controller refuses to provide information, it must indicate in writing the provision that allows for such refusal.
Right to Legal Action:
If the data subject’s rights are violated, they may take the case to court, which will proceed without delay. Cases are under the jurisdiction of the competent district court, but the case may also be initiated at the court corresponding to the data subject’s residence or place of stay. The data controller must prove that the data processing complies with the law.
If the data controller causes damage to others due to unlawful processing of personal data or by breaching data security requirements, it must compensate for the damage. If the unlawful processing or breach of data security violates the data subject’s personal rights, the data subject may claim compensation. The data controller is exempt from liability if it proves that the damage or the violation of personal rights was caused by an unavoidable event outside its control. No compensation is due, and no damages are payable to the extent that the damage or the harm to personal rights resulted from the data subject's intentional or grossly negligent behavior.
