Only individuals who have residence or a place of stay in the following European Union countries, possess a valid personal identification card issued by the authorities of a relevant country, have a personal Mobilfox webshop profile, and are at least 16 years old, may participate in the Game. Participants must be capable of acting on their behalf during the entire duration of the Game and not fall within the category of excluded individuals ("Player"). Participating Countries: Hungary, Czech Republic, Croatia, Poland, Spain, Portugal, Germany, Austria, Romania, Bulgaria, Greece, Latvia, Lithuania, Estonia, Slovenia, Slovakia, Netherlands, Belgium. Individuals under the age of 18 can participate in the Game or receive a prize only with the consent of their legal representative. Upon request, any Player or Winner is required to present this consent to MOBILREDFOX customer service. Participation in the Game requires creating an individual profile on the MOBILREDFOX website and purchasing a Product. A total of 15 (fifteen) daily winners will be selected through a random computerized draw conducted after the campaign between 2024.12.12 and 2024.12.21, from all orders received that day on all websites owned by MOBILREDFOX. The Organizer reserves the right to change the Prize and replace it with another prize of equivalent value. Please note that all registered Players who make a purchase on the Organizer's website during the Prize Game period and buy at least one Full-Shock or Pro-Shock case are included in the Game and accept the terms outlined in these Game Rules by making the purchase. The Game is not considered gambling as defined by Act XXXIV of 1991 on the Organization of Gambling. The MOBILREDFOX creates a closed database from the daily purchases of the Players participating in the Game. From this database, MOBILREDFOX randomly selects the daily winners by computer (without human intervention). The draw is not public. The Organizer selects a total of 15 (fifteen) Winners, and no substitute winners will be drawn. If the winner does not respond within 5 (five) calendar days, their participation in the Game is invalid for any reason, or they are excluded for any other reason specified in these Game Rules, or they do not collect the Prize at the designated time and agreed location, the Prize will not be redrawn. This Game is not sponsored, endorsed, organized, or in partnership with Apple. The data provided by the Winners are submitted to MOBILREDFOX's database and used as specified in the Game Rules. Apple does not support or collaborate with the Game in any way, nor does it administer or track the participants. |

Prizes: |
Prizes: 15 (fifteen) Apple iPhone 16 smartphones. The Prize is non-transferable and will only be awarded to the Winner by the Organizer. MOBILREDFOX will notify the winning Player within 24 hours of the draw by the following means (“Notification”): MOBILREDFOX will notify the Winner via email about the Prize within 24 hours of the closed draw. The Winner must contact MOBILREDFOX customer service within 5 (five) calendar days to arrange the Prize handover details. If the Winner does not confirm the Notification via email or provide the necessary details for receiving the Prize within the specified timeframe, they will be excluded from the Game. MOBILREDFOX excludes from the Game any Player whose prize cannot be awarded due to inaccurate, incomplete, or incorrect personal information provided in the purchase confirmation or for any other reason that disqualifies the Player under the Game Rules. The Organizer is not responsible for any consequences of incorrect data provision by the Player.
MOBILREDFOX is not responsible for any circumstances arising from the Winner’s use of the Prize or any related issues experienced by third parties after the Prize has been awarded. Any modifications to these Game Rules, or any notification of potential suspension or termination, will be published by MOBILREDFOX at https://mobilfox.com/pages/black-friday-2024. DATA PRIVACY NOTICE
By accepting the Terms, you explicitly consent, based on appropriate information, to the processing and storage of your personal data by MOBILREDFOX as the data controller. This processing is in accordance with the European Parliament and Council Regulation (EU) 2016/679, dated April 27, 2016, on the protection of natural persons regarding data processing and on the free movement of such data, repealing Directive 95/46/EC (GDPR), Article 6(1)(a), as well as relevant legal requirements, for the purpose of participation in the Game and communication with MOBILREDFOX for the necessary period until the purpose of data processing is achieved or consent is withdrawn.

Legal Basis of Data Processing
We inform you that MOBILREDFOX processes Players' data based on their consent per GDPR Article 6(1)(a) and processes the data of selected Winners under GDPR Article 6(1)(b) as necessary for the performance of a contract (the delivery of prizes and fulfillment of the gifting contract).
Scope of Data Processed and Retention Period
During the Game organization and prize distribution, MOBILREDFOX will process the following data:
- For all Players: Name, Email Address, Phone Number.
- For Winners: Name, Email Address, Phone Number, and any additional data required for organizing accommodations and travel as requested by the lodging or travel provider.
Data Retention Period:
Data will be stored for 5 years after the end of the Game in accordance with the general limitation period specified in the Hungarian Civil Code. Financial data qualifying as accounting records related to the Prize will be stored for a minimum of 8 years, according to Act C of 2000 on Accounting, Section 169(2).
If we process your data based on your consent, you may withdraw your consent at any time without restriction by emailing info@mobilfox.com. Following withdrawal, MOBILREDFOX will promptly delete your data.
Automated Decision-Making (Including Profiling):
No automated decision-making or profiling is carried out during data processing.
Data Recipients and Categories of Recipients:
In relation to the Game, no targeted data transfer occurs. However, data from registered accounts may be forwarded to data processors (notably Shopify and Infobip), resulting in certain personal data being transferred to third countries (such as the United States). Detailed information on specific data processing, including the legal basis provided by Chapter V of the GDPR, is available in Appendix 3 of the Data Privacy Notice.
Data Security
The data controller takes all reasonable measures to prevent accidental damage or destruction of data. Specific data security measures are detailed in the Data Privacy Notice.
Rights of Data Subjects
The GDPR provides detailed rights and remedies for Players regarding their personal data, as well as any restrictions. Below is a summary of the key provisions.
Right to Information:
If the data controller processes personal data related to the Player, it must inform the Player of the main characteristics of the data processing, including its purpose, legal basis, duration, identity and contact information of the data controller and its representative, the recipients of personal data, and the Player's rights and remedies concerning data processing (including the right to lodge a complaint with the supervisory authority). The data controller provides this information to the Player through this notice.
Right of Access:
Players have the right to receive confirmation from the data controller as to whether personal data concerning them is being processed and, if so, to access such data and relevant information about the processing, including its purposes, the categories of personal data involved, the recipients of the data, the duration of processing (planned), the Player’s rights and remedies (including the right to lodge a complaint), and, where applicable, the source of the data if not collected directly from the Player. Upon request, the data controller provides a copy of the personal data processed to the Player. Additional copies may be provided for a reasonable administrative fee. The right to access must not adversely affect others' rights and freedoms. The data controller provides information on the availability, method, potential costs, and other details of access upon the Player’s request.
Right to Rectification:
Players have the right to request the prompt correction of inaccurate personal data concerning them. Taking into account the purposes of processing, Players may request the completion of incomplete personal data, including through a supplementary declaration.
Right to Erasure ("Right to be Forgotten"):
Players have the right to request that the data controller erase their personal data without undue delay, and the data controller is obligated to delete personal data without undue delay if specific conditions are met. Among others, the data controller must delete personal data if the data is no longer necessary for the purposes for which it was collected or otherwise processed; if the Player withdraws consent and there is no other legal basis for processing; if the data was processed unlawfully; or if the data must be erased to comply with a legal obligation under Union or Member State law. Players should note that the data controller may retain data as required by law even if the Player requests its deletion.
If data processing is based on the Player's consent, the consequence of withdrawing consent is that the Player will not be able to use the application.
Right to Restrict Processing:
Players have the right to request that the data controller restrict processing if any of the following conditions apply:
- The Player contests the accuracy of the personal data, in which case processing is restricted while the accuracy of the data is verified.
- The processing is unlawful, and the Player opposes the erasure of the data, requesting restriction of its use instead.
- The data controller no longer needs the data for processing purposes, but the Player requires it to establish, exercise, or defend legal claims.
If processing is restricted, such personal data may only be processed with the Player’s consent or for legal claims, or for the protection of another natural or legal person’s rights, or for reasons of public interest.
If the restriction on processing is lifted, the data controller will notify the Player in advance.
Right to Data Portability:
Players have the right to receive personal data they have provided to the data controller in a structured, commonly used, and machine-readable format, and they may transmit that data to another data controller without hindrance, where:
- Processing is based on consent or necessary for the performance of a contract (with the Player as a party), and
- Processing is carried out by automated means.
When exercising the right to data portability, the Player may also request direct transfer of the data to another data controller, where technically feasible.
The right to data portability does not adversely affect others' rights and freedoms.
Legal Remedies and Additional Rights
The Right to Complain:
The data controller makes every effort to ensure that personal data is processed in compliance with legal requirements. If the data subject believes that the data controller has not complied, they may send a complaint to info@mobilfox.com or by post to the following address: 1061 Budapest, Dalszínház utca 2, 4th floor, Mobilredfox office.
If the data subject feels that their rights to personal data protection have been violated, they may seek legal remedy with the relevant authorities, including the Hungarian National Authority for Data Protection and Freedom of Information (NAIH) at 1055 Budapest, Falk Miksa utca 9-11., or with a court. Legal remedies and rights are further outlined in the GDPR.
Right to Information Regarding Personal Data Processing:
Data subjects may request information about the processing of their personal data at any time, and the data controller may only refuse to provide information in exceptional cases as outlined by law. If the data controller refuses to provide information, it must indicate in writing the provision that allows for such refusal.
Right to Legal Action:
If the data subject’s rights are violated, they may take the case to court, which will proceed without delay. Cases are under the jurisdiction of the competent district court, but the case may also be initiated at the court corresponding to the data subject’s residence or place of stay. The data controller must prove that the data processing complies with the law.
If the data controller causes damage to others due to unlawful processing of personal data or by breaching data security requirements, it must compensate for the damage. If the unlawful processing or breach of data security violates the data subject’s personal rights, the data subject may claim compensation. The data controller is exempt from liability if it proves that the damage or the violation of personal rights was caused by an unavoidable event outside its control. No compensation is due, and no damages are payable to the extent that the damage or the harm to personal rights resulted from the data subject's intentional or grossly negligent behavior.
